1 Who we are and what these terms cover

These Terms of Service govern access to kithcard.com and any Kithcard website, digital feature, or support or messaging service that links to these terms (the “Services”). They are an agreement between you and Kith Financial, Inc., doing business as Kithcard (“Kithcard,” “we,” “us,” or “our”). Our Privacy Policy describes how we handle personal information.

Kithcard is a financial technology company, not a bank or credit union. These terms govern our digital Services; they are not a cardholder agreement, loan agreement, or commitment to provide credit. Any financial product made available through Kithcard will be subject to separate agreements identifying the responsible issuer, lender, or servicer and the applicable eligibility requirements, costs, risks, and terms. The applicable product agreements control any conflict relating to that product.

2 Acceptance and eligibility

By using the Services after receiving reasonable notice of these terms, or by affirmatively accepting them when requested, you agree to these terms. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter into an agreement. The Services are intended for people in the United States. Individual financial products may have additional requirements, including age, residence, property, or underwriting requirements.

A caregiver, family member, or representative may assist someone only with appropriate permission and legal authority. Assistance does not automatically authorize access to another person’s account, information, or funds. We may require verification of authority before providing access or information.

3 Waitlists and information about products

Joining a waitlist or submitting an inquiry does not create a financial account, constitute a completed credit application, reserve a credit limit, or guarantee availability, approval, pricing, rewards, or a launch date. Features and availability may change. Examples, calculators, and estimates are illustrative; actual results depend on the applicable product and your circumstances.

General educational content and automated responses are not individualized legal, tax, investment, or financial advice. They may be incomplete or inaccurate. Confirm important information with an appropriate professional or the responsible financial provider. Do not rely on a website summary as a substitute for your product documents.

4 Your information and account security

Provide accurate information and update contact details when they change. Use only information you are entitled to provide. Do not submit Social Security numbers, full card or bank account numbers, passwords, or sensitive documents through ordinary email, SMS, or waitlist forms. If we offer secure accounts, protect your credentials and notify us promptly of suspected unauthorized access. These terms do not determine liability for unauthorized financial transactions or reduce rights under applicable law or product agreements.

5 Text messages and other communications

Providing a phone number or accepting these terms does not by itself enroll you in recurring texts or authorize marketing texts. We send texts only after obtaining the consent appropriate to the program and message type. The enrollment notice identifies Kithcard as sender and describes the messages you request. The Kithcard Support and Verification program covers requested customer support and identity or login verification, where available. It does not include lending solicitations or promotional messages.

If you enroll, texts may be sent using automated technology. Message frequency varies with your requests and activity. Message and data rates may apply. Consent to texts is not a condition of purchasing goods or services, joining our email waitlist, or applying for or obtaining credit. You must be the subscriber or authorized user of the number you provide and notify us if you stop using it.

Reply STOP to stop texts. Standard opt-out keywords and other reasonable requests to revoke consent will also be honored as required by law. We may send one nonpromotional confirmation, then stop messages covered by your opt-out. We will not resume them unless you consent again. Reply HELP for help or contact hello@kithcard.com. You may also revoke consent by contacting that address. Stopping SMS does not close an account or cancel obligations under a separate agreement. If you disable verification texts, a feature may be unavailable unless an alternative verification method is available.

Texts can be delayed, misdirected, or undelivered, and may be visible to anyone with access to your device. Carriers are not responsible for delayed or undelivered messages. Do not send sensitive financial information by SMS. Our Privacy Policy explains protection of mobile information and consent records. Any future marketing program will require a separate enrollment process and applicable provider approval; these terms do not enroll you in it.

We may respond to inquiries and send administrative emails related to the Services. You can unsubscribe from marketing emails using the link in the message. Marketing opt-outs do not prevent lawful nonmarketing communications. Electronic delivery of disclosures that legally require a separate consent will be addressed separately; these terms are not that consent.

6 Permitted and prohibited use

We permit personal, lawful use of the Services and grant a limited, revocable, nonexclusive, nontransferable license to access them for that purpose. You may retain copies of your own records and publicly available disclosures. You may not impersonate others; submit information without authority; commit fraud; interfere with security or availability; introduce malicious software; access restricted systems; harvest personal data; send spam; infringe intellectual property; or copy, scrape, resell, or commercially exploit the Services without permission, except as allowed by law. Do not reverse engineer software except where applicable law permits it despite this restriction.

7 Ownership and submissions

Kithcard and its licensors own the Services and their content, software, names, and designs. You retain ownership of information and materials you submit. You grant us permission to process those materials only as needed to provide the Services, respond to you, and carry out purposes described in our Privacy Policy. Voluntary product feedback may be used without payment; this does not make your personal or financial information public or authorize its sale.

8 Third parties and service availability

Links and integrations may connect you to independent providers. Their services have their own terms and privacy notices. A link does not imply a guarantee or endorsement. We remain responsible for obligations imposed on us by law. Do not assume a provider is an issuer, lender, or partner merely because it is mentioned on our site.

We may maintain, change, restrict, or discontinue digital features, or suspend access for suspected misuse, security concerns, or legal requirements. We will provide notice where required or reasonably practicable. Any action affecting an existing financial product remains governed by the applicable agreement and law. Stopping digital access does not eliminate financial obligations or statutory rights.

9 Disclaimers

To the extent permitted by law, the website and general informational content are provided as available, without promises of uninterrupted access, error-free operation, or fitness for a particular purpose. We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to the extent legally permitted. This disclaimer does not override an express promise in a separate agreement, our Privacy Policy, or a duty or remedy that cannot lawfully be excluded.

10 Limits on liability

To the extent permitted by law, neither party is liable to the other under these website terms for indirect, incidental, special, consequential, or punitive damages arising from use of the Services. This limitation does not apply to fraud, intentional misconduct, gross negligence, a breach of confidentiality or data protection obligations, or liabilities or consumer remedies that cannot be limited by law. It does not limit rights concerning unauthorized transactions, billing errors, servicing errors, or credit reporting under applicable law or separate product agreements. Where a jurisdiction does not permit a limitation, that limitation does not apply.

11 Questions and disputes

Please contact hello@kithcard.com about a concern so that we can try to resolve it. Contacting us first is not a condition of filing a claim or complaint and does not shorten any deadline. These website terms do not require arbitration, waive jury or class rights, or restrict complaints to regulators. Applicable federal law and the law determined by the court under its conflict-of-law rules govern these terms. A dispute may be brought in a court with lawful jurisdiction and venue. Separate product agreements may contain additional lawful provisions governing product disputes.

12 Changes and other provisions

We will post revised terms with an updated effective date and provide additional notice of material changes as required by law. Changes apply prospectively. We will obtain affirmative agreement where required rather than treating website use as consent to a materially different obligation. If you do not accept revised terms, stop using the affected Services, subject to any separate product agreement.

If a provision is unenforceable, the remainder continues to apply. A failure to enforce a provision is not a waiver. You may not transfer rights under these terms without our consent. We may transfer these terms in a lawful business reorganization, subject to your privacy rights and the SMS restrictions in our Privacy Policy. These terms govern their stated subject only and do not replace separate financial product agreements or mandatory law.
